These Terms of Service ("Terms") govern your use of VoiceConsole, a product of Tested Media LLC ("Company", "we", "us", or "our"). By accessing or using our platform at voiceconsole.ai ("Service"), you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using VoiceConsole, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not use the Service. Continued use of the Service after changes to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

VoiceConsole is a SaaS analytics and management platform designed for voice AI agencies. The Service provides:

  • Real-time call analytics and performance dashboards
  • AI-powered call scoring, sentiment analysis, and coaching
  • A/B testing and prompt optimization tools
  • Live call monitoring and quality assurance
  • Campaign and lead management
  • Compliance tracking and automated reporting
  • Integration with third-party voice AI platforms (Retell AI, Vapi)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when possible.

3. Account Registration

To use VoiceConsole, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information remains current and accurate

You must be at least 18 years old to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscription Plans & Billing

VoiceConsole offers multiple subscription tiers. Paid plans are billed on a monthly or annual basis, as selected at the time of purchase.

  • Billing cycle: Subscriptions renew automatically unless cancelled before the renewal date
  • Price changes: We will provide at least 30 days notice before any price increase takes effect
  • Refunds: We do not provide refunds for partial billing periods. You may cancel at any time and retain access until the end of your current billing period
  • Payment: All payments are processed securely through Stripe. We do not store credit card information on our servers

5. Free Tier

VoiceConsole offers a free tier that includes limited access to core features. The free tier is subject to usage limits (agents, calls per month, data retention) as described on our pricing page.

We reserve the right to modify free tier limits at any time. Free tier users will receive at least 14 days notice before any reduction in included features or limits.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without prior written consent
  • Upload or transmit viruses, malware, or other harmful code
  • Use the Service to harass, abuse, or harm others
  • Circumvent usage limits or abuse the free tier

Violation of these terms may result in immediate account suspension or termination without refund.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You retain ownership of all data you upload to or generate through the Service ("Your Data"). By using the Service, you grant us a limited license to process Your Data solely for the purpose of providing and improving the Service.

You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including obtaining necessary consents for recording and analyzing voice calls.

8. Intellectual Property

The Service, including its source code, design, features, documentation, and branding, is owned by Tested Media LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

You may not copy, modify, or create derivative works based on the Service without our express written permission.

9. API Usage

API access is available on select subscription tiers. Use of the VoiceConsole API is subject to:

  • Rate limits as documented in our API documentation
  • The same acceptable use policies that govern the Service
  • API keys must be kept confidential and not shared publicly
  • We reserve the right to revoke API access for abuse or excessive usage

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTED MEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

You may terminate your account at any time through your account settings or by contacting support. We may terminate or suspend your account if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account has been inactive for more than 12 months (free tier)
  • Required by law or regulatory authorities
  • We cease providing the Service (with reasonable notice)

Upon termination, your right to access the Service ceases immediately. We will retain Your Data for 30 days after termination, during which you may request an export. After 30 days, Your Data will be permanently deleted.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Send an email notification to the address associated with your account
  • Display a notice within the Service for at least 30 days

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in San Francisco, California.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
